Terms of Service

1. Agreement and eligibility

By creating an account or using TaxTrail, you agree to these Terms and our Privacy Policy. You must be legally able to enter a contract and use the service only in compliance with applicable law. If you use TaxTrail for an organization, you represent that you may accept these Terms for it.

2. Service license and accounts

Subject to these Terms, TaxTrail grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the service for your lawful record-organization needs. You are responsible for accurate account information, activity under your account, and protecting your credentials. Promptly tell us about suspected unauthorized use.

3. Your content

You retain ownership of receipts, images, mileage records, notes, and other content you submit. You give TaxTrail and its service providers a limited worldwide license to host, copy, transmit, process, display to you, and otherwise use that content only as needed to operate, secure, support, and improve the service, provide requested cloud and AI processing, and comply with law. You represent that you have the rights needed to submit the content. This permission ends when the content is deleted, except for limited retained copies described in the Privacy Policy or required by law.

4. Plans, limits, and billing

Features and limits depend on your plan and are shown on our Pricing page. Smart Receipt and Smart Trip Scan allowances reset monthly and do not roll over. Other limits, including Free-plan total trip limits, saved trips, active recurring schedules, and export access, may apply. We may adjust limits prospectively with reasonable notice.

Monthly and annual Pro plans are billed in advance through Stripe and automatically renew for the same billing interval until canceled. Prices, applicable taxes, and billing frequency are shown before purchase. You authorize Stripe to charge your selected payment method. You can manage or cancel a Stripe subscription from the subscription area in Settings. Cancellation stops renewal and Pro access remains through the paid period, after which the account returns to applicable Free limits. See the Refund Policy.

5. Lifetime access

If a Lifetime plan is offered and purchased, “lifetime” means access for the operational lifetime of the TaxTrail service and account, not the lifetime of any person and not a promise that TaxTrail or any company will exist indefinitely. Lifetime access is non-transferable, remains subject to these Terms, available features, reasonable usage and scan limits, and service changes. It does not include separate products or services not identified as part of the purchased plan.

6. Acceptable use

You may not break the law; infringe rights; upload malicious or unlawful material; probe, disrupt, overload, reverse engineer, scrape, or bypass the service or its limits; access another person's account; resell access without permission; or use TaxTrail to develop a competing model or service. We may suspend access needed to address abuse, security risk, nonpayment, or a material violation.

7. Tax and AI disclaimer

TaxTrail organizes records; it is not a tax professional, accountant, attorney, or financial adviser. TaxTrail is not endorsed by or affiliated with the IRS or any tax authority. Smart Scan, categories, summaries, mileage rates, and estimated deductions may be incomplete or wrong and are not tax, legal, accounting, or financial advice. You are responsible for reviewing records, keeping source documents, determining eligibility, and filing accurately. Consult a qualified professional for advice.

8. Availability and backups

The service is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted operation, accurate AI results, permanent availability, or recovery of stored records. TaxTrail is not a substitute for your own copies and backups. We may maintain, modify, suspend, or discontinue features or the service.

9. Liability

To the maximum extent permitted by law, TaxTrail and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, tax benefits, data, or business opportunities arising from the service. Our total liability for claims relating to the service will not exceed the amount you paid TaxTrail for the service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited, including liability that cannot legally be limited. Nothing in these Terms waives non-waivable consumer rights or other rights required by law.

10. Ending use

You may stop using TaxTrail at any time and may request account deletion. We may terminate or suspend access for material or repeated violations, legal or security reasons, nonpayment, or discontinuation of the service. Provisions that by their nature should survive will survive, including ownership, disclaimers, liability limits, and payment obligations already incurred.

11. Changes and contact

We may revise these Terms. We will post the revised version, update the date above, and provide additional notice of material changes when appropriate. Continued use after revised Terms take effect means you accept them; if you do not, stop using the service and cancel any renewal. Questions may be sent to support@taxtrail.online.
